Abuse - The Lies

Those under suspicion for the abuse Kelsey suffered were Raye Dawn, Kathie Briggs, and Lance Briggs. Kelsey had been with Raye Dawn, Kathie, and Lance the two times abuse was confirmed and she was with Mike Porter when she was sexually assaulted and murdered.

 

At Raye's trial, it was made clear that Kelsey was with Kathie when her legs were broken. In an answer to Raye's appeal, the Attorney General agrees that Kelsey was not with Raye Dawn or Mike Porter when her legs were broken. Who does that leave?

 

Despite claims that Kathie has been cleared of any abuse, nobody has been cleared of abuse in Kelsey's case. Another lie is that Lance was in Iraq during the entire ordeal. However, Lance was in the state and was with Kelsey on the two times abuse was confirmed. He was also in Shawnee on the day of at least one of the hearings and he chose not to attend.

That has been my position all along. If you cannot determine the perpetrator leave the child in a neutral location. Judge Key should have left Kelsey with her maternal grandmother.

I will also add, since the murder, I have officially been ruled out as the perpetrator. FINALLY! To bad Judge Key, DHS, the Guardian ad litem, the ADA and CASA could not take the time and use the common sense it took to figure it out. Thank you Richard Smothermon.

One of the amazing things about this case as well is that Lance was listed as a possible perpetrator and he was not even in the state, yet I lived in the home at the time with Kelsey and never once was I questioned. My two children were also in the home. They never questioned them or checked to see if they were being abused by my parents as well. If they truly thought the abuse was coming from my parents home, then why in the world were they not checking into me or checking on my children? None of this will ever make sense to me, EVER!!!

This is from the confidential OCCY report. It clearly states that Kathie Briggs was not and has not been cleared of any abuse toward Kelsey:

After months of reflection and review, the Lincoln County staff demonstrated an attitude of suspicion of the paternal grandmother, Kathie Briggs. The OJSO has considered the possibility that the paternal grandparents were somehow involved in one or more of the incidents reported. Within this context, after examining the evidence and DHS case history the following alternatives must be considered:

a)      Ms. Briggs was the perpetrator of some of the incidents of abuse and child welfare failed to adequately investigate and document her involvement.

b)      Ms. Briggs was not the perpetrator, but, by her demeanor, persistence, and/or irritation, was able to  negatively influence DHS professional child welfare investigators so that her concerns were not properly investigated.

c)      DHS staff did not consider the danger to Kelsey significant to warrant a thorough investigation.

d)      DHS staff did not comprehensively review the case to consider the contextual evidence implicating a different perpetrator.

 

 

It's been reported that Kelsey suffered nine months of abuse at the end of her life.

 

The truth is, we don't know how long Mike Porter abused her.

 

It could have been nine months, nine days, nine hours, or nine minutes prior to Kelsey's death.

 

But we do know that the "documented abuse" is not what's been shown to the public.

 

There were two cases of documented abuse:

1. Bruises on Kelsey's bottom (January, 2005)

2. Kelsey's broken legs (April, 2005)

 

Both of these instances have been argued by professionals as accidental injuries, and they both happened while Kelsey had been in the custody of both Lance and Kathie Briggs. If you take the two instances that DHS considered to be abuse away from Raye Dawn and put them where they belong, with the Briggs, then what is left to charge Raye Dawn?

 

Kelsey was murdered while Raye Dawn wasn't home. Mike Porter was home with Kelsey and he lied about the events surrounding her death. Mike Porter's daughter stated that her dad hurt Kelsey when Raye Dawn wasn't in the room.

 

Mike Porter was a perfect husband to Raye Dawn and seemed to be a perfect father to Kelsey during the four months they lived together as a family. Once Kelsey no longer saw the Briggs, her injuries stopped, until the day she died.

 

Raye Dawn was not to blame for a drunk driver hitting the vehicle that she, Mike Porter, and Kelsey were riding in when it was totaled. Photos of Kelsey's injuries from that serious accident have been shown in videos and are all over the internet as signs of abuse. If that's the case, why isn't the man who was driving drunk when he totaled their vehicle the one in jail for abuse?

People ask why Raye Dawn didn't leave Mike Porter and blame her for allowing him to abuse Kelsey. There was no evidence of abuse that Raye Dawn saw at the time. Mike Porter's ex-girlfriend and the grandmother to his daughter both said he was a good father. Nobody suspected Mike Porter for the monster he is. Ted Bundy wasn't suspected and neither was BTK. Mike Porter was a wolf in sheep's clothing, a true sociopath.

 

Raye Dawn thought she had finally won her fight for Kelsey and had gotten custody of her daughter. She thought she finally found a good father figure for Kelsey. She suggested counseling for Kelsey to find out why Kelsey was injuring herself and not sleeping. Raye Dawn is the only one who fought for Kelsey. If she had known who Mike Porter really was, she would have left him without ever looking back. Raye Dawn saved herself from the abusive relationship with Lance Briggs. She would have saved Kelsey too, had she known Mike Porter was an abuser. Raye Dawn did everything asked by the state to regain custody of her daughter. She fought to keep Kelsey from being raised by an abusive drug addict (Lance Briggs). She thought her life was going to get better, but Mike Porter fooled her and everyone else in Raye Dawn's family.

 

So why is Raye Dawn now sitting in prison and serving a 27 year term for enabling child abuse?

 

Why are the lawmakers and officials in Oklahoma allowing this injustice to occur?

 

Why isn't anyone stepping up and doing the right thing?

 

Why wasn't Mike Porter tried for murder and sexual assault?

 

Following is a montage of Kelsey's injuries during her final nine months.

 

All of which have a logical explanation for an active toddler and do not show a child beaten and neglected as the public has been led to believe.

 

 

 

This is from the confidential OCCY report. The injuries in these pictures are from an automobile accident:

"On Friday August 19, 2005 at 10:23 pm, Kelsey was involved a car accident with Raye Dawn and Mike Porter. Medical records indicated that Mike Porter, Raye Dawn Porter and Kelsey arrived the Unity Health Care Center emergency room on August 20, 2005 at 12:36 am. The chief complaint was documented as elbow pain and trunk pain. An emergency room nurse documented a reddened area to the left eye. The RN wrote: Records indicate the family left before 2:45 am, and did not remain for an examination by a physician....On Saturday August 20, 2005, the CHBS case manager completed a critical injury report. The report stated: CCMS received a call on 8/20 at 8:27 am from mother who reported the family was in a serious accident about 10 pm the night before. She stated that their new pick-up truck was totaled and that Kelsey had bruises from the car seat. Mother stated that Kelsey had bruises on her face and abdomen. The family had contacted Yolanda Hunter, CWS who advised them to take the child to the ER. Mom stated that the ER triage nurse had told them that Kelsey had no apparent internal injured and that if she did have she would not be able to be so rambunctious."

According to the D.A. Richard Smothermon, Mike Porter sexually assaulted and murdered Kelsey Shelton Smith-Briggs on October 11, 2005. He was home alone with Kelsey and according to his daughter's statement, he abused Kelsey when Raye Dawn wasn't in the room. Five agencies watched over Kelsey and nobody saw signs of Mike Porter's abuse. Other than being hit by a drunk driver, after Kelsey was taken away from Kathie Briggs and put with Gayla Smith and then Raye Dawn, Kelsey had no other injuries.

Raye Dawn had been married to Mike Porter for six months when he killed her precious daughter. We're told "she should have known." Raye Dawn thought Kelsey was doing well and so did her attorney, the Assistant D.A., and everyone else involved with the child.

Does it look like Kelsey was really beaten and neglected for nine months? She was an active two-year-old and her mother did everything that she thought was right to give her daughter a safe and happy home.

The picture taken on April 18, 2005 clearly shows Kelsey's right leg. She was walking with a limp and standing.

Diagnosed with bilateral tibia fractures.

 

The picture above was taken the day Raye Dawn married Mike Porter. Kelsey had sprained her ankle while at the zoo with her aunt Miste. Raye Dawn took Kelsey (who was walking) back to Kathie's after this picture and when she picked her up for visitation four days later Kelsey couldn't walk. Kelsey had crawled in Kathie's floor for days and Kathie didn't take her to the doctor. Raye Dawn took Kelsey to the DHS office after she realized Kelsey wasn't walking and both of her legs were hot and swollen and then she took her to the doctor and the doctor put casts on Kelsey's legs. Raye Dawn then took Kelsey back to Kathie's and Kathie THEN took her to a hospital that is known for saying children's injuries are abuse and Kathie told the doctor that Kelsey had been abused.

The first doctor had correctly diagnosed Kelsey with bilateral toddler fractures and Kathie's doctor said it was abuse. The doctor removed Kelsey's casts. The Smiths had to have the casts put back on Kelsey. DHS took Kelsey from Kathie at that point because allegedly she became a prime suspect for the abuse Kelsey had suffered.
